The American people endured 8 years of an Obama era defined by abuse of power. We all can agree on that.
President Barry O abused policy to punish companies and expand the size of government. Often he manipulated long-standing tradition to get his way.
Tradition that wasn’t Constitutionally sound. He broke the law, over and over, to get his way.
Now things are different. President Trump is undoing decades of insider politics. He is requiring government agencies to actually follow the law. Obviously some people don’t like it. Namely: corrupt Democrats.

The litigation concerns an agency’s decision to allow career bureaucrats to preside as the functional equivalent of judges during enforcement proceedings. These officials, called administrative law judges (ALJs), are hired by career bureaucrats. They are not appointed by the president, a court or an agency head, but they exercise significant authority on behalf of the U.S. government in official proceedings…
The Constitution requires that the president, the courts, or the head of an executive department appoint all “inferior officers” of the United States.
A group of investment managers challenged the Securities and Exchange Commission’s (SEC) use of ALJs in an enforcement proceeding convened against them for alleged violations of securities law… The Obama Justice Department sided with the SEC in the dispute, but Trump’s new solicitor general, Noel Francisco, changed positions Wednesday, and backed the money managers.
“Upon further consideration, and in light of the implications for the exercise of executive power under Article II, the government is now of the view that such ALJs are officers because they exercise ‘significant authority pursuant to the laws of the United States,’” Francisco wrote in a new brief at the Supreme Court.
Obama allowed a tradition of non-appointed bureacrafts to rule as judges. These people were not appointed according to the Constitution, but by people within the agency. That meant they had zero accountability to the President and the American people. Bad move.
Obama let it happen within the SEC, because these “ALJs” were going after the financial sector. Once again, Democrats attacking business. But they did so against the law.
Under Trump, agencies cannot appoint these insiders to act as judges. Only the rightful leaders can decide who is calling the shots. That way, government agencies can run out of control. Trust me, you don’t want bureacrats acting like judges.
Another win for small government and the American people.
